On June 16, 2021, the Superior Court of Quebec authorized Ménard, Martin, Avocats to institute a class action against Vigi Santé Ltée and to appoint Ms. Evangelina Morfonios as class representative: Judgment Authorizing the Exercise of a Class Action against Vigi Santé Ltd.
On September 15, 2021, the firm Ménard, Martin, Avocats filed a Request to Institute a Class Action.
The class action involves the following group:
“Every person who resided at CHSLD Vigi Mont-Royal at any time since March 13th, 2020, as well as their spouse, their family caregiver(s), their children and grandchildren, their heirs and successors.”
On April 20, 2022, the prosecutors for Vigi Santé Ltée filed an Act of Forced Intervention against four parties:
- The West-Central Montreal Integrated University Health and Social Services Network;
- The Minister of Health and Social Services;
- The Minister Responsible for Seniors and Caregivers; and
- The Attorney General of Quebec.
On June 30, 2022, the defendants-in-warranty agreed to this forced intervention.
On January 4, 2023, following a hearing on file held on December 29, 2022, Justice Donald Bisson ruled on the protocol and setting down for trial deadline. This decision notably confirms the following elements:
- The setting down for trial deadline is extended to July 30, 2024;
- The Court authorizes the examination of third parties; and
- The expertise and counter-expertise of the Plaintiffs and the Defendants will relate to the following disciplines:
- Public health
- Microbiology
- Epidemiology
- Geriatrics
- Mechanical ventilation
It should be noted that this class action holds only for the CHSLD Vigi Mont-Royal and anyone who meets the group’s criteria is automatically part of the class action.
